Terms & Conditions of Sale - Camino Rose

Welcome to Camino Rose! These Terms & Conditions govern all contracts and dealings between Camino Rose Pty Ltd (ACN 654 699 224) ("Camino Rose", "we", "our" or "us") and you ("You"), the customer, relating to the purchase of goods and/or services through our website ("Website"). By placing an order and purchasing goods from Camino Rose via the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

1.Changes to Terms & Conditions

1.1We reserve the right to amend, remove, or vary these Terms & Conditions at any time without notice. Any changes will become effective immediately upon publication on the Website, and by continuing to visit, access, or use the Website, you agree to be governed by the updated Terms & Conditions.

2.Privacy Policy

2.2 Please review our Privacy Policy, which outlines how we collect, use, and store your personal information. By placing an order and purchasing goods from Camino Rose via the Website, you consent to the processing of your personal information as described in the Privacy Policy, and you warrant that all provided personal information is accurate.

3.Terms of Sale

3.1. Ordering: By placing an order ("Order") for any goods on the Website, you are offering to purchase the goods on and subject to these Terms & Conditions. Camino Rose may accept or reject any Order, and each accepted Order will create a separate and binding agreement between you and Camino Rose.

3.2. Order Confirmation: All Orders are subject to availability of goods and confirmation by Camino Rose. If you don't receive a confirmation email within 24 hours of placing your order, please contact Charlie@caminorose.com.

3.3. Personal Use Only: You acknowledge that all Orders placed through the Website are intended for personal and domestic use only.

3.4. Eligibility: To contract with Camino Rose, you must be at least 18 years old and possess a valid credit or debit card issued by an acceptable bank. If you are under 18, a parent or guardian must place the Order on your behalf.

3.5. Order Accuracy: When placing an Order, you affirm that all details provided to Camino Rose are true and accurate, and you are an authorized user of the payment method used.

3.6. Prohibited Resale: The resale or distribution of Camino Rose goods purchased on the Website is strictly prohibited.

4.Payment and Pricing

4.1. Price: The Price for goods is specified on the Website and excludes any delivery fee.

4.2. Currency and GST: All Prices quoted are in Australian dollars ($AUD) and include goods and service tax ("GST"), where applicable.

4.3. Price Changes: Camino Rose may change Prices of goods on the Website without prior notice, except for Orders already confirmed at a stipulated Price.

4.4. Payment Methods: Payment for Orders must be made immediately on placing the Order. We accept PayPal or credit card payments (MasterCard®, Visa, and American Express). Gift certificates issued by Camino Rose can also be used for purchases.

4.5. Credit Card Debit: Your credit card will only be charged when the Order is dispatched for delivery.

4.6. Fraudulent Conduct: You agree not to engage in any fraudulent conduct or contravene any law while paying for goods.

4.7. Tax Invoice: Camino Rose will provide you with a tax invoice after payment processing.

5.Delivery

5.1. Dispatch: Orders will be dispatched on the next business day in Sydney, Australia (excluding public holidays), following full payment of the Price.

5.2. Estimated Delivery: Delivery times are estimates and may vary due to availability, location, and postal delays. Camino Rose is not liable for any delays caused by force majeure.

5.3. Risk Upon Delivery: Once delivered, all risk for loss or damage to the goods becomes your responsibility.

5.4. Shipment Check: You should check your shipment on delivery for discrepancies and note any issues on the delivery notice, if possible.

5.5. Order Confirmation: You will receive an Order confirmation after purchase, and a tracking number will be provided after dispatch.

5.6. Delivery Method Changes: Camino Rose may amend delivery methods without notice.

5.7. Delivery Redirect: Orders cannot be redirected after dispatch.

5.8. Australian & New Zealand Orders:

• Deliveries will be made by a third-party provider.
• If your nominated delivery address is unattended, follow the Delivery Provider's instructions.
• Delivery times vary depending on location.
• Delivery fees apply based on order total.

5.9. International Orders:

• International deliveries are made by the Delivery Provider.
• Delivery times vary depending on the destination country.
• Delivery fees apply based on order total.
• Customs may apply taxes or duties at the destination country, which are your responsibility.

 

• Cancellation and Returns Policy
• 6.1. Cancellation: No cancellations or changes to Orders will be accepted unless provided for under these Terms and Conditions.

6.2. Returns: You may return new and unused items within 14 days of receipt if the goods are in their original condition with tags attached (if any). Camino Rose will refund the purchase price minus shipping and handling charges. Return postage is at your expense.

6.3. Returns Address: Send returns to PO Box 3722 Rouse Hill NSW 2155.

6.4. Condition of Returns: Goods must be in their original purchase condition for return.

6.5. Refund Processing: Camino Rose will process refunds within 5 days of receiving returned goods.

6.6. Return of Defective or Incorrect Goods: If a good is faulty, damaged, or doesn't correspond with your Order, notify Camino Rose via email within a reasonable timeframe. Camino Rose will inspect the good and may provide a refund, replacement, or repair.

6.7. Return Shipping: You are responsible for return costs unless Camino Rose agrees otherwise.

6.8. Exchanges: Camino Rose does not offer online exchanges. To exchange goods, return the original items and place a new order.

6.9. Retailer Returns: Camino Rose does not process returns for goods purchased from retailers.

 

7.Limitation of Liability and Indemnity

7.1. Consumer Guarantees: These Terms and Conditions do not modify or exclude the conditions, warranties, guarantees, and other legal rights under the Australian Consumer Law and other laws.

7.2. Liability Limitation: Camino Rose's liability, to the extent permitted by law, is limited to the remedies provided in clause 7.4.

7.3. Indemnity: You agree to indemnify Camino Rose against any third-party claims, liability, damages, and costs arising from your use of the Website or breach of these Terms and Conditions.

7.4. Remedies: Camino Rose's remedies for defective or incorrectly delivered goods are limited to:

(a) Providing a refund;

(b) Replacing the Goods; or

(c) Repairing the Goods.

7.5. Handling and Use Risk: Risk for loss or damage to the goods passes to you upon Delivery, and you indemnify Camino Rose for any loss or damage to the goods after possession.

8.Disclaimer of Liability

8.1. Content Accuracy: Camino Rose does not guarantee the accuracy
